Need help getting someone out of jail?

Felony charges and the right court

Find out which Fulton court can decide bond and where the criminal case records belong.

THE QUICK ANSWER

A felony label does not tell you the bond price or which judge can grant release. Confirm the exact charge, statute, current order and any separate hold. Fulton Magistrate, Superior, State and municipal courts have different roles.

Start with the case and court

Fulton Superior Court handles felony criminal matters. State Court handles cases below felony level, including misdemeanors and traffic cases within its jurisdiction. Magistrate Court conducts first appearances, warrant applications and preliminary hearings. City courts maintain their own municipal cases. The arresting agency, holding jail and trial court can be different organizations. Match the person, case number and court on each document.

Some bail decisions need Superior Court

Georgia reserves bail for listed serious offenses to a Superior Court judge, subject to permitted delegation in some cases. Examples include murder, rape, armed robbery and certain other specified offenses. It does not reserve every felony in the same way. Ask defense counsel to identify the controlling charge and the judge authorized to act. The first appearance judge should explain when bail cannot be set at that hearing. A separate motion or hearing may be necessary.

Use the actual order, not a price range

Ask for the amount and permitted security on each charge, any special conditions, whether the order has reached the jail and every additional hold. If no amount appears online, ask whether that reflects incomplete booking, a pending judicial decision or an actual denial. A bondsman may quote company terms only for a bond it can accept; its quote does not establish court eligibility. For missing or unaffordable bail, ask counsel about court review.

Use the current county records route

On September 16, 2026, the Clerk’s September 11 notice reported reSearchGA unavailable for Superior and Magistrate records and directed visitors to the Fulton County Courts Public Portal. If a record is missing or conflicts with paperwork, contact the criminal clerk at 404-613-5313 and counsel. State Court has its own official records entry point. An online search result is not a change to the written release order or appearance notice.
